October 14, 2022 by stephenh

At Canyons Law Group, we strive to provide the best advice and counsel with the utmost compassion and professionalism. Many people agree to act as executor or trustee without really knowing what that means. When the day arrives, however, they feel incapable and overwhelmed during times of grief. We will help our clients see that they are up to the task and that it’s not nearly as difficult as it may seem.

We will help you to both clearly see the big picture and zoom in on all the fine details. We can map out a clear path that is easy to follow and then guide you through each step as you go.

We work hard to make sure the process is smooth and easy for you to understand. Estate administration always comes during a time of grief. We know this well as we’ve experienced it in our own personal lives. We strive to provide the utmost compassion and support to our clients in all that we do at Canyons Law Group.

How We Can Help with Estate Administration

In some cases, estate administrations are required to go through a Utah probate court. This is a court process required by Utah law in certain cases. During the probate process, the estate’s outstanding debts (if any) are paid after which assets may be distributed to the beneficiaries.

In general, people hope to avoid the process because the estate assets are frozen during the process, which can often be lengthy and costly. We work closely with you during this time to make the process as quick and easy as possible. Our attorneys can assist with:

  • management and/or guidance over all of the trustee or personal representative’s legal responsibilities;
  • document preparation and formal filings with probate court;
  • compliance with life insurance policies;collecting documentation and information relating assets/titles and outstanding bills, debts, and medical liabilities;
  • quick and responsive help with urgent matters such as child custody, small business management concerns, and securing the home/personal property;
  • cancelling/deferring upcoming mortgage payments;
  • transparent accounting for debt payments, sale of asset(s), disbursements, and any other concern relating to the estate’s finances with continuing updates for beneficiaries;
  • securing the decedent’s mail and deliveries and updating forwarding addresses;
  • assistance with pension matters and Social Security; and
  • ongoing trust administration.

There are quite a few minute details that must be strictly followed according to Utah law during the administration of an estate. Often, there are time-sensitive deadlines that must be met. It is a lot to manage, especially during a time of loss.

Canyons Law Group can help manage many of these mundane burdens for you, helping you to quickly jump through all legal hoops and allowing you more bandwidth to navigate difficult emotional times. We are here to provide you with the best legal services from start to finish.

Trusts Offer Greater Flexibility

October 11, 2022 by stephenh

People often choose to set up a trust as part of their estate plan because it better protects and preserves wealth and minimizes tax liability. Depending on your circumstances, you may or may not want a trust as part of your estate planning.

At Canyons Law Group we work closely with you to identify your goals and intentions and offer our years of experience to guide and counsel you as you plan your estate.

Trusts Offer Potential Wealth Protection

Setting up a trust is particularly valuable because it can lessen the high tax burdens associated with large estates. This maximizes the total value that can be passed to family, loved ones, and other beneficiaries.

More commonly, trusts are designed specifically for the purpose of avoiding the need to go to probate court. If a person dies with only a will and no trust, Utah law requires that the will must go through probate court before the assets of the will can be distributed. Going through probate court usually means that the assets are frozen for several months or even several years. This process is often costly, which eats away at the overall value of your estate, leaving less behind for those people who really matter.

Setting up a trust means that your assets will not be frozen and your trustee will have continuous access and control over the assets as you have directed. It further ensures that the assets in your estate will pass to your beneficiaries quickly and directly.

Unique Trusts for Unique Needs

Depending on your circumstances, you might have specific needs for which a specific trust can be set up to meet those unique needs. For example, you may need to set up special protections for a disabled child to ensure proper care without disqualifying them from government benefits.

At Canyons Law Group, we work closely with you to assess and meet your unique needs, whatever they might be. We offer experience with all varieties of trusts, such as, revocable living trusts, family trusts, supplemental needs trusts, spendthrift trusts, life insurance trusts, charitable trusts, pet trusts, and irrevocable trusts.

Comprehensive Estate Planning in Utah

October 11, 2022 by stephenh

Estate planning is the process of creating all the necessary legal documents to ensure that your loved ones receive every benefit you wish to leave for them. These documents set forth your clear intentions with a thoughtful course of action to support your loved ones, help them honor your wishes, and ensure that your assets go to their best use.

A good estate plan is like a road map that helps your loved ones navigate difficult terrain they will encounter after your death or incapacitation. Without it, families and friends often become entangled in probate court and costly litigation that often rips loved ones apart and eats up the value of your estate.

You want your estate plan to function as a gift to your loved ones, not only through the assets that it will convey, but also in providing them with peace of mind in knowing your clear intentions and avoiding any arguments and fighting that might otherwise occur.

At Canyons Law Group, we work closely with you to tailor and fit your plan to the unique needs of your unique family and loved ones.

We Offer Thoughtful Planning With a Variety of Options and Documents So We Can Tailor Fit Your Estate to the Unique Needs of your Family and Loved Ones.

We customize each of our plans to fit your specific objectives and goals. This often includes:

  • Wills
  • Trusts
  • Power of Attorney
  • Advance Health Care Directive (Living Will)
  • HIPAA Release
  • Burial / Funeral Instructions
  • Guardianship Documents
  • Conservatorship Documents

Most people benefit from setting up a trust alongside a traditional will. A trust is necessary for your loved ones to avoid all of the time, money, and possible litigation associated with probate court in Utah. It helps to ensure that your estate pays as little tax as possible to preserve and pass on as much of your wealth as possible.

At Canyons Law Group, we work to make sure that you have all necessary documents prepared properly with your desires and intentions.

We Offer Free Consultations and Cost-Effective Options
